Terms of Use - OneScore

These Terms of Use (Terms) apply to your use of OneScore Mobile Application (OneScore/OneScore App) published by FPL Consumer Services Private Limited (OneConsumer), to fetch your Credit Score and Credit Report from various Credit Information Companies (CICs). Clicking on ‘Submit’ or ‘I Agree’ or any similar tab/icon would mean acceptance of the below terms and conditions by the OneScore app user (You).

OneScore shall present to you an analysis of your credit profile and provide insights on the main components of the Credit Score including your accounts and payment details as provided to OneScore by CICs on your behalf. As long as you comply with these Terms, FPL CS grants you a personal, non-exclusive, non-transferable, limited license to use the OneScore App and its services.

1. Scope of Services

FPL CS owns and manages the OneScore mobile application that enables you to view, analyse, and understand your Credit Score as available in the credit bureau. The app also includes other related features that help in understanding and improvement of credit score, such as an AI powered score planner, blogs, infographics, simulators, quizzes and in-app suggestions.

2. Eligibility

By registering with FPL CS and using the App Services, you are representing that

a) You are 18 years of age or older;

b) You are capable of entering into a legally binding agreement;

c) You are not barred or otherwise legally prohibited from accessing or using FPL CS under the laws of India.

If you allow anyone to use your account, including individuals under 18 years of age, you will be responsible for ensuring that such individuals comply with the terms. You will be responsible for all actions these individuals take in and/or through your account. You also acknowledge that FPL CS does not have the responsibility of ensuring that you meet any of the aforesaid requirements.

3. Registering on OneScore

To avail services on our App, you are required to first download our App, and then provide some personally identifiable information as part of the registration process, which includes but is not limited to the following:

• Your name

• Email address

• Mobile number

• Permanent Account Number (PAN)

• Date of Birth

• Gender

• Address

FPL CS may require you to provide additional details, as and when required, in order to comply with any applicable regulatory requirement or for additional services/products via the App as and when offered, and may also utilize data lawfully obtained from third party service providers authorised by the User, including but not limited to data pertaining to the User’s Credit score, to provide the App services.

Once you complete this process, you will be a registered user of the OneScore App, which allows you to access and use the services provided in the App.

By providing us with your email address and mobile number, you consent to receiving service-related notices, including any notices required by law, in lieu of communication by postal mail. We may also use your email address or mobile number to send you other messages, including changes to features of the service as well as any special offers on our own products.

4. Authentication

While completing the registration process you will be provided with a One-Time Password (OTP) or any other authentication code as part of our security procedures. Kindly treat such information as confidential, and do not disclose it to any third party.

In the event you disclose such information to a third party, FPL CS shall not be responsible for any loss or damage that may occur. You agree to immediately notify us of any unauthorised use of your password, by sending such details to us on support@onescore.app

You are responsible for any access to the App through your Account, whether such access is directly by you or through any third party. You will also be responsible and liable to us for all activities that take place or occur through and in your Account.

You agree that your ability to log into your Account is dependent upon external factors such as Internet Service Providers and Internet network, and we shall not be liable for any damages or consequences arising from your inability to log into your account.

5. Your Use of OneScore

When you use our App, you are representing to us that:

a) Your use of the App shall not violate any applicable law or regulation;

b) All registration information you submit is truthful, complete and accurate;

c) Your use of the App, or its content is only for personal purposes. Your personal and non-commercial use of the App prevents you from decompiling, reverse engineering, disassembling content, removing any intellectual property right associated with our App, including copyright, trademarks, trade secrets, designs, and patents, or other proprietary notices;

d) You shall not access or use the App in any manner that may be harmful to the operation of the App or its content;

e) You shall not use any product or service available on the App for commercial purposes, or use the App Services in any way that is unlawful, or harms FPL CS or any other person or entity;

f) You will not post, distribute, or otherwise transmit or make available any software or other computer files that contain a virus or other harmful component, or otherwise impair or damage the App or any connected network, or otherwise interfere with any person or entity’s use of the App;

g) You will not delete or modify any content of the App, such as legal notices, disclaimers or proprietary notices, copyright or trademark symbols and logos;

h) Your use of OneScore shall indicate that you have provided consent to automatically receive requested updates such as bug fixes, patches, enhanced functions, missing plug-ins and new versions (collectively, ‘Updates’), for the purpose of effective delivery of the App Services. Please note that your continued use of the App following such Updates would mean deemed acceptance by you of the same.

6. Violation of Terms of Use and/or Suspicious Activity

If we believe that you have violated any of the conditions as mentioned under these Terms or our Privacy Policy, we reserve the right to suspend your access to the App and/or delete your Account.

If we have reason to believe that there is suspicious or unusual activity being carried out through your account, we may temporarily or permanently suspend your access to the App Services.

You agree to provide true, accurate, current and complete information about yourself as and when prompted by the App. If you provide any information that is untrue, inaccurate, not updated or incomplete (or becomes untrue, inaccurate, not updated or incomplete), or FPL CS has reasonable grounds to suspect that such information is untrue, inaccurate, not updated or incomplete, FPL CS shall have the right to suspend or terminate your account and/or refuse any and all current or future use of the App (or any portion thereof) or Services in connection thereto.

7. Use and Protection of Intellectual Property Rights

FPL CS, OneScore and the App Services are protected by copyright, trademarks, patents, trade secret and/or other intellectual property laws. No information, content or material from the App may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way without ONECONSUMER’s express written permission. You are hereby given a limited licence to use the App Services, subject to your agreement of these Terms.

When you upload, submit, store, send or receive content that may include feedback to or through our App, you give FPL CS a worldwide, perpetual licence to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly display and distribute such content. This licence shall not revert to you even if it is not used by FPL CS. The rights you grant in this licence are for the limited purpose of operating, promoting, and improving the App Services, and to develop new ones. This licence continues even if you stop using the App Services.

8. Disclaimer of warranties and limitation of liability

You agree that FPL CS provides the OneScore App on an “as is”, “with all faults” and “as available” basis. No representations, warranties or guarantees whatsoever are made by FPL CS as to the (i) accuracy, adequacy, reliability, completeness, suitability or applicability of the information to a particular situation; (ii) that the service will be uninterrupted, timely, secure, or error-free; (iii) the quality of any services, content, information, or other material on the website or App will meet your expectations or requirements; (iv) any errors in the Site and the App will be corrected; (v) warranties against infringement of any third party intellectual property or proprietary rights; or (vi) other warranties relating to performance, non-performance, or other acts or omissions of the Company, its officers, directors, employees, affiliates, agents, licensors, or suppliers.

The Company does not warrant that any of the software used and or licensed in connection with this App or website will be compatible with other browsers, third party software or devices nor does it warrant that operation of the website and App and the associated software will not damage or disrupt other software or hardware.

The Company, its affiliates, successors, and assigns, and each of their respective investors, directors, officers, employees, agents, and suppliers (including distributors and content licensors) shall not be liable, at any time for any, direct, indirect, punitive, incidental, special, consequential, damages arising out of or in any way connected with the use of the website or Apps, whether based in contract, tort, strict liability, or other theory, even if the Company have been advised of the possibility of damages.

9. Redirects

When you use our App or website, you may access a link that directs you to a third-party site. Such sites are not controlled by FPL CS and different terms of use and privacy policy may apply. FPL CS is not responsible for those sites, and may disable these links, upon our review and analysis of the same. FPL CS disclaims all liability arising from your access to or use of such third-party sites.

10. Governing Law and Jurisdiction

The App, the App Services, all your transactions with the App, and our relationship shall be governed by the laws of India, without regard to conflict of law principles. You agree that all claims, differences and disputes which we may have shall be subject to the exclusive jurisdiction of the competent courts located in Pune.

11. Credit Information Aggregates obtained from CICs

FPL CS Technologies can only access your Credit Information Aggregates such as credit score and report as your authorised representative and shall use the Credit Information Aggregates for limited end use purpose consisting of and in relation to the services proposed to be availed by you from us on the App or Website.

We shall not aggregate, retain, store, copy, reproduce, republish, upload, post, transmit, sell or rent the Credit Information Aggregates to any other entity and the same cannot be copied or reproduced other than as agreed herein.

The Parties acknowledge that the Credit Information Aggregates provided to FPL CS are solely the property of CICs and You (as appropriate). We shall protect and keep confidential the Credit Information Aggregates both online and offline and use best in class security measures in line with applicable laws.

The Credit Information Aggregates shared by You, or received on your behalf shall be destroyed, purged, erased or returned to CICs promptly either when you require FPL CS to expressly do so and/or seek to revoke the consent or if it is mandated or intimated by regulators. The relationship between you and the Parties shall be governed by laws of India and all claims or disputes arising there from shall be subject to the exclusive jurisdiction of the courts of India.

Understand how your data is protected

Steps and Security Safeguards to be taken by Credit Institutions for ensuring Accuracy, Completeness and Protection Of Data

OneScore shall use the Credit Information Report (“CIR”) solely for limited end use as agreed with you (“Individual User”) and shall not use or sell or resell or pass on information to any other person, or engage itself in obtaining CIR other that for the consented purpose. Please note that OneScore shall not use, sell, resell, pass on information to any other person, or engage itself in obtaining a CIR that has not been consented for by you (“End Use”).

“Individual Consent” means the prior consent of the individual by any documented means, stored as an electronic or physical record verifiable from time to time and permanent in nature:

The Individual Consent provided by you will be stored permanently and verifiable. The Individual Consent is on an opt in basis and you shall have access to the link containing detailed terms of use containing the process for revocation of consent, opt-out and a grievance mechanism for your use and reference. Such terms of use provided to you in English are accessible at https://www.onescore.app/legal/cibiltnc/

Your CIR shall be shared with OneScore’s employees and/or agents only on a “need to know basis”, and will ensure that such employees and agents will be subject to an obligation of confidentiality.

The CIR shared by Credit Information Companies (“CIC”) with OneScore is stored only for a limited time period of six months, till such time the credit information is required to be retained to satisfy the purpose for which it was intended, or till when you choose to revoke your consent to store such credit information, whichever is earlier.

By providing such Individual Consent, you authorise OneScore at its discretion to:

Request and receive reports from CICs for the following six months;

Retain and store the CIR for a period of six months from the date of the credit information having been provided by the CIC; and

Extend the time period as stated above for a further period of six months every time you log into the OneScore mobile application or the OneScore website.

In an instance where you fail to access the log on and provide such Individual Consent to OneScore within a period of six months from the last date of access, OneScore shall purge the CIR obtained on your behalf from its storage systems. Post such purging, you shall be required to provide OneScore with a fresh consent in order to obtain your CIR from the CICs.
